Clark T. Thiel, AIA, Esq. is highly experienced in the resolution of disputes involving U.S. and
international engineering and construction projects, as well as contract disputes. His
expertise includes service in the Initial Decision Maker process, on a Dispute Review Board,
and the neutral role in both Mediations and Arbitrations. In addition to the practice of law, he
is also a registered architect and a licensed contractor. Mr. Thiel has served as an appointed
neutral in more than a hundred construction industry disputes.
In his law practice, Mr. Thiel has served as lead counsel in numerous construction
arbitrations and mediations. His practice includes the prosecution and defense of multimillion
dollar complex construction disputes involving delay and acceleration claims, breach of
contract, professional liability, design and construction defects, economic loss, and liens and
encumbrances. He also assists clients in drafting and negotiating design and construction
contracts. Mr. Thiel has authored a number of articles on construction claims and damages
and is a frequent speaker on these topics. He further possesses extensive knowledge of
copyright, trademark, licensing, and trade secret issues specific to the construction industry,
and advises building owners, general contractors, subcontractors, architects, engineers, and
other design professionals on anticipating and managing the associated risks inherent in the
construction process.
In his lengthy tenure as a practicing architect, Mr. Thiel was involved in all phases of the
design and construction of civic, commercial, and residential projects throughout the U.S. and
Asia. In addition to working on a variety of building types, including convention centers,
sports arenas, and correctional facilities, he performed on-site construction administration
services for projects such as the Crescat Residences and Shopping Complex in Colombo, Sri
Lanka (a luxury condominium hotel and shopping center, complete with pools, salons, spa,
grocery store, and Sri Lanka's first underground parking structure) and ShadowRidge, a 44-
unit hillside townhouse development in Honolulu, Hawaii.
Mr. Thiel is a member of the American Bar Association, American Institute of Architects, and
Barristers' Club Construction Law Committee and currently serves as planning commissioner
for the city of Piedmont, California
